Terms of Use

Please read our terms of use carefully before contracting our services and make sure your account will not violate any term. As our client, you will have ethical and legal responsibilities regarding the use of services. Goalmoon reserves the right to suspend or cancel access to your account, without refund of amounts paid, if we determine that the account has been used inappropriately.

Goalmoon Tecnologia LTDA (hereinafter referred to as Goalmoon) – Terms of Service and Usage Policy

Server Abuse

Any attempt to ruin or cause damage to one of our servers or clients is punishable by immediate account cancellation. Attempting to use other people's accounts or Goalmoon computers without authorization is punishable by immediate account cancellation (if applicable) and legal action against the offender.

Any violation of the following terms of service will result in action by Goalmoon up to and possibly including the termination of your account, with or without prior notice.

Main Provisions

1. Goalmoon is a private service headquartered in Londrina, Brazil, that offers web hosting services.
2. Goalmoon has the right to cancel any account for any reason below or without any previously prescribed reason.
3. Goalmoon provides web hosting services for any client who acts in accordance with our terms and conditions.
4. Goalmoon has the right to change the terms and conditions at any time.
5. At Goalmoon, users are entirely responsible for all activities conducted through their accounts.

Main Usage Restrictions

• Adult content is not allowed on our servers.
• Warez, hacking, or phishing are not allowed.
• Mass sending is not allowed.
• File or image sharing scripts are not allowed.
• Paid-to-surf, auto-surf, buxto, and any other similar scripts are prohibited.
• Nulled software such as IP.Board, vBulletin, Datalife engine, or any other is not allowed.

Prohibited Uses

You agree NOT TO USE the Goalmoon service to:

1. Abuse minors in any way.
2. Identity fraud.
3. Forge headers or manipulate identifiers in order to disguise the origin of any content transmitted through the services.
4. Upload, post, email, transmit, or make available any content that is:
   • Illegal, harmful, threatening, abusive, offensive, defamatory, obscene, invasive of others' privacy, racial, ethnic, or objectionable.
   • Protected by copyright or for which you do not hold the rights to use.
   • Arising from contractual or fiduciary relationships.
   • Protected by or that violates any patent, trademark, trade secret, copyright, or other third-party intellectual property rights.
   • Unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.
   • Or that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any software or hardware.
   • Broadcast and/or Streaming type content.
5. Interfere with or disrupt services, servers, networks connected to the service.
6. Intentionally or accidentally violate any applicable national, state, or local law or international law.
7. Provide material support or resources for any organization designated by the Brazilian government as a foreign terrorist organization.
8. Promote harassment or stalking.
9. Maintain or collect personal data about users in connection with prohibited conduct and/or activities listed in the items above.

User Responsibilities

1. Make payment on the due date, in accordance with the contracted plan value.
2. Keep any programming codes secure and audited. When using third-party software, the user is obligated to always use an updated and secure version of the software.
3. Provide true, updated, and complete information, based on which the relationship rules between the parties will be defined.
4. Notify any changes to registration data, including email changes, under penalty of all notices sent to the registered addresses being considered valid.
5. If the information provided is incorrect or incomplete, undergoes uncommunicated changes, or makes it impossible to identify the user, Goalmoon may cancel or suspend the contracted services.
6. The user will bear full responsibility for misuse of the service, as per all items above, or any other form of violation of Brazilian or international legislation.

Goalmoon Responsibilities

1. Ensure the efficiency of servers, adopting all necessary measures to avoid damage to their operation.
2. Guarantee the functioning of the contracted service for at least 99% of monthly time, except in cases of force majeure.
3. Technical support will be provided through our support area at https://suporte.goalmoon.com.
4. Not disclose any user registration data, as well as transferred and stored information, except in case of court order.

About Account Opening, Upgrades, and Service Installation

Promotionally, all hosting accounts will be activated for the trial period immediately and automatically. The period offered will be the one announced on the site at the time of subscription and cannot be changed.

1. Non-payment of the monthly fee within the period offered at the time of subscription will end the trial period and the account will be deleted from our servers.
2. Goalmoon service monthly payments will be paid by registered credit card, with charges sent on the due date.
3. Goalmoon will not charge any additional amounts for changes from one plan to another whenever requested by the user.

About Login and Access Password

1. The login and password for the service will be created by Goalmoon when opening the account in the system. The user may change their password if desired.
2. The responsibility for keeping the password for system access is exclusively the user's. Goalmoon bears no responsibility for its misuse.

Refund Policies

1. Users may cancel services at any time through a support ticket request or through their account control panel. Goalmoon provides a 30-day refund guarantee for ONLY hosting plans and ONLY through OUR OWN PAYMENT METHODS.
2. Goalmoon reserves the right to change the prices of its services upon notification to the user with 15 (fifteen) days in advance.
3. The client acknowledges that discounts are NON-RECURRING in ALL promotions, being valid only for the first purchase.
4. Monthly plans will only have the discount applied in the first month.
5. Domains are NOT refundable, except in cases where the domain was not registered due to the REGISTRAR's refusal.

General Regulations

1. You and anyone who has access to your account must evaluate and assume the associated risk, accuracy, integrity, or usefulness of any content.
2. You may terminate your account at any time for any reason. To remove your Goalmoon site, log in to your account control panel.
3. When signing up with Goalmoon, your email is automatically added to our mailing list. Goalmoon reserves the right to send you promotional emails.
4. To the fullest extent permitted by applicable law, Goalmoon will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use Goalmoon's services.
5. GOALMOON.COM SERVICES ARE OFFERED TO YOU "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES BEYOND THE MAXIMUM EXTENT PERMITTED BY LAW.
6. Goalmoon reserves the right to change any technical procedure related to contracted services without prior notice.
7. The user acknowledges and agrees that Goalmoon may delete all data, files, or other information stored in the user's account if the account has been suspended for more than 15 days due to non-payment.
8. The user is responsible for all damages arising from their use of the services, and agrees to indemnify and hold Goalmoon harmless from any legal claim.
9. Goalmoon reserves the right to suspend a user's service at any time, for any reason, without notice, when any infringement or violation of the Terms of Use is verified.
